Introduction

These terms of use govern your purchases from, and your use of, the www.myjournalto.com website and forms a contract between you and My Journal To ApS (43513710), Hollænderdybet 30, st. th. 2300 Copenhagen S, Denmark (hereinafter “My Journal To”). By making a purchase from, and using, this website you have agreed to these terms of use. Please make sure that you have read and understood these terms of use when using our site.

Please click the "I accept" checkbox under the payment information in the checkout process if you accept these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any products from our site.

1. Confirmation

Your order constitutes an offer to us to buy and pay for a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been despatched ("the despatch confirmation"). The contract between us ("contract") will only be formed when we send you the despatch confirmation. We recommend saving this email in order to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as a guarantee of proof of purchase.

The contract will relate only to those products whose despatch we have confirmed in the despatch confirmation. We will not be obliged to supply any other products which may have been part of your order until the despatch of such products has been confirmed in a separate despatch confirmation.

We reserve the right to refuse any order you place at our sole discretion.

2. Payment

Payment is taken at the time of purchase.

No fees are charged for credit cards.

My Journal To does not store any credit card numbers.

3. Promo codes

Promo Codes should be entered during the checkout process to be valid. Attempting to add a promo code after purchase will not be honored.

4. Taxes

All prices shown on the My Journal To website, www.myjournalto.com, are including VAT, in accordance with the applicable legislation.

Please note that in case of an order is shipped to a delivery address outside the EU, you may be subject to import duties and taxes, which are collected when the shipment reaches your delivery address. You will be responsible for the payment of such import duties and taxes. It should be noted that My Journal To has no control over these charges and, since these charges are different for different countries, My Journal To cannot predict their amount. My Journal To advises you to contact your local customs office for further information.

5. Ordering and returns

Orders made in another person's name without the person’s consent will be reported to the authorities. My Journal To holds the right to change prices, and correct incorrect prices on all orders as well as final sales. If a price is incorrect, this may compel My Journal To to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.

Consumers have the right to return the order within 14 days of receiving the order. The right applies only if the product and its original packaging can be returned in the same condition as when received. My Journal To holds the right to additional charges if the return does not meet these criteria. If consumers use their right to send back an order they should contact My Journal To in order to get an address to send the goods to.

If an item is defected or damaged in any way on arrival, My Journal To should be contacted within 14 days for information about compensation. My Journal To hold the right to refuse any returns made after this timeframe.

6. Privacy policy

We will treat all your personal information as confidential and will only use it in accordance with our Privacy Policy. In addition, we will process information about you in accordance with our Privacy Policy. By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.

When you shop on this Website, we will ask you to input personal details in order for us to identify you, such as your name, e-mail address, billing address, delivery address, credit card, or other payment information. We confirm that this information will be held by us in accordance with the registration we have with the Data Commissioner's office.

7. Product

My Journal To has the right to adjust prices, involve additional costs, and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the watch. The pictures may differ depending on the color settings on your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.

8. Delivery and cancellations

Your order will normally be delivered in 4 - 6 working days after you have placed your order. In any event, the order will be fulfilled within 30 days of the date of the dispatch confirmation unless there are exceptional circumstances.

Once at the checkout screen, both delivery charges and estimated delivery times will be displayed. Additional delivery charges may apply to remote areas or for large, bulky items.

We will email you as soon as the order has been dispatched.

My Journal To ships worldwide. Deliveries are made in cooperation with postal services and their partners. You have the right to cancel purchases and return delivered goods by contacting My Journal To customer service or using the contact form on the My Journal To website within 14 days of receiving the goods provided the goods are unpacked and in the same condition as when you received them. However, the customer is responsible for the risk of transporting the returned goods to My Journal To.

In cases, you as a customer believe that the delivery is delayed in such a way that you no longer wish to fulfill the order, it is your responsibility to cancel the order. In cases where the order has been dispatched, the customer is required to receive the order. Cancellation is not valid until the customer has confirmed with My Journal To via one of the contact methods on the contact page. If a product has been discontinued My Journal To has the right to cancel the purchase and refund the paid amount to the customer. My Journal To will notify the customer of a replacement or equivalent products if available.

9. Complaints terms

It is important that you as a customer carefully check your goods/products when you receive your shipment in order to verify that the products are not damaged and correct. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact us within 14 days of receiving the product.

Any complaints shall be made to our customer service through one of the contact methods on the contact page. Please supply the order number and the reason for the complaint and we will get back to you shortly. The same applies to returns. Defective products returned to My Journal To should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. My Journal To has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund. In the case that a returned product has no errors or faults, My Journal To will send the product back to the customer.

10. Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representations, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall My Journal To be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

The Website is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided by you. You must bear the risk associated with the use of the Internet.

Whilst we will try to ensure that the material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. If we are informed of any inaccuracies in the material on the Website we will attempt to correct this as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

You may also share content from the Site via email through the use of our Email a Friend link. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title, or interest in any downloaded materials or software is transferred to you as a result of any such downloading, sharing, or copying. The www.myjournalto.com website may include user-generated content, for example, social media applications. My Journal To does not claim any ownership in rights in such content (images, photos, videos, etc.) And take no legal responsibility for it. In case you suspect a violation of copyright or any other right, or otherwise are offended by such content, please contact our customer service.

15. Reviews

If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You grant My Journal To and its sub-licensees the right to use the name that you submit in connection with such content if they choose.

You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

You agree to perform all further acts necessary to perfect any of the above rights granted by you to My Journal To, including the execution of deeds and documents, at the request of My Journal To.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as of the date that the content or material is submitted to My Journal To: The content and material are accurate;

Use of the content and material you supply does not breach any applicable My Journal To guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify My Journal To for all claims brought by a third party against My Journal To arising out of or in connection with a breach of any of these warranties.

17. Retention of title

All products remain in My Journal To property until full payment is made.

18. Fraud

All frauds are reported to the authorities and My Journal To reserves the right to cancel the purchase if any suspicion is raised.

19. Governing law and jurisdiction

These terms and your use of the www.myjournalto.com website are governed by Danish law. To the extent permitted by law, Danish courts shall have exclusive jurisdiction of any dispute arising from these terms of use and your use of the website, subject to My Journal To the right to prosecute a user at his/her place of residence.

20. Termination

My Journal To reserves the right to terminate your account and/or your use of the www.myjournalto.com website at its sole discretion. For example, if My Journal To suspects that you have breached these terms of use. Such termination can be made without prior notice.

21. Amendments

My Journal To may revise these terms of use from time to time. Every time you order a product from us, the general conditions in force at that time will apply to the contract between you and My Journal To. You should therefore periodically visit this page to review the then-current terms to which you are bound.

22. Referral scheme t&c’s

Subject to the terms set out below, you may earn ‘credit’ for use on this Website by referring a new customer(s) to us through our referral scheme by sharing the referral link and/or referral code we provide to you (the “Referral Scheme”). You are only eligible to participate as a ‘referrer’ in this Referral Scheme if you have previously placed an order on the Website.

A new customer is a natural person who has not previously placed an order with us (a "Referee"). If the Referee has an account on the Website but has not previously placed an order on the Website then they are entitled to participate in the Referral Scheme through the ‘referral link’ only. If the Referee already has an account on the Website then they will be unable to participate in the Referral Scheme using a ‘referral code’ (regardless of whether they have previously placed an order).

If the Referee has clicked through your referral link the discount code will automatically be applied at checkout. If the Referee is using a referral code, the Referee must enter this code at checkout.

For the avoidance of doubt, any credit generated from the Referral Scheme may only be spent on the Website and neither you nor the Referee is entitled to receive any payment of any kind in respect of the credit. The credit is not redeemable for cash. The credit that stands to your Referral Scheme account is not transferable in any way.

You will receive the applicable credit on your account 24 hours after the despatch of the Referee's order. If the Referee cancels their order for any reason within 3 days of it being despatched, you will not qualify for any credit. You will receive your credit in the default currency of the Website.

Any credit accrued through the Referral Scheme that has not been used within 12 months from the date of accrual will expire.

The Referee must place an order with a value of at least the minimum value as stated on the Website from time to time.

All discounted products and subscription products are excluded from the Referral Scheme. If you are participating in the Referral Scheme, you will be unable to participate in any affiliate schemes, cash-back offers, and/or any other promotions of this nature.

We may, in our sole discretion, withdraw your credit generated from the Referral Scheme at any time if we believe or suspect that your use of the Referral Scheme is fraudulent, misleading, or contrary to these terms.
